Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://otakunest.moe (the "Site") and any purchase made from Akazuki Works UK Ltd, trading as Otaku Nest ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you are under that age, you may only use the Site with the involvement of a parent or guardian.

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@otakunest.moe if you suspect unauthorized use.

We make reasonable efforts to display product colors, materials, and descriptions accurately, but we do not guarantee that your device's display is accurate. Product availability is not guaranteed until an order is confirmed.

Prices are shown in USD unless a currency selector states otherwise, and exclude taxes, duties, and shipping unless stated at checkout. If a product is listed at an incorrect price due to a typographical, pricing, or system error, we may cancel the order, notify you, and refund any amount charged, even after an order confirmation has been sent.

Limited-drop items are produced in fixed quantities and may sell out without notice. We reserve the right to limit order quantities per customer or address on any product, including to deter resale or automated ("bot") purchasing, and may cancel orders that appear to violate this limit.

Your order is an offer to purchase. An order confirmation email acknowledges receipt of your order but is not our acceptance of it — a contract is formed only when we confirm the item has shipped. We may refuse or cancel any order for reasons including product unavailability, suspected fraud, or an error in pricing or product information.

Payment is processed at the time of order through our third-party payment processor. We do not store full payment card numbers on our servers.

Returns, withdrawal rights, and refunds — including statutory rights available to US and EU consumers — are described in our Refund Policy. Nothing in these Terms limits any statutory consumer right that cannot lawfully be waived.

The Site, including its text, graphics, logos, product designs, and artwork, is owned by or licensed to Akazuki Works UK Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Site or its product designs without our prior written consent. Purchasing a product does not grant any license to reproduce the artwork printed on it.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, other accounts, or our systems;
• Use automated means (bots, scrapers) to access the Site or place orders except where we permit it;
• Interfere with the Site's operation or security features; or
• Submit false information, including at checkout or in a returns request.

The Site is provided "as is" without warranties of any kind, express or implied, except where required by law. To the fullest extent permitted by applicable law, Akazuki Works UK Ltd will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited under the law of your country of residence, including statutory consumer guarantees under UK, EU, or US state law.

These Terms are governed by the laws of England and Wales, United Kingdom, without regard to conflict-of-law principles. Subject to the paragraph below, the courts of England and Wales, United Kingdom have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.

If you are a consumer resident in the European Union or another country whose law gives you the right to bring proceedings in your own country regardless of this clause, that mandatory right is not affected by this section.

We may update these Terms from time to time. Changes take effect once posted to this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
